1. Acceptance of Terms

By accessing or using IsItBob ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.

2. Description of Service

IsItBob is a 2-player social guessing game where players upload photos, build boards, and play by asking yes/no questions. The Service is provided on a free and paid subscription basis.

3. Accounts & Registration

You may use the Service as a guest (limited access) or by creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

You must be at least 13 years old to use the Service. By registering, you confirm that you meet this requirement.

4. Your photos

Adding a photo to IsItBob is like sending a photo in a messaging app. The people you play with can see it while you play. If someone reports a photo, we look at it too. Nobody else can. When you add a photo, you accept these Terms.

What stays the same

• The photo is still yours. We do not sell it, use it in ads, or show it outside the game.
• You can delete a photo yourself whenever you like. A daily limit on deleting applies (see Plan Limits), so contact us if you need one gone right away.
• When you delete a photo, or your account, it disappears from the game at once and we remove the file from our storage. If another account added the exact same image, that file stays for them.

What you let us do

• Store the photo and show it to the players in your games. That is all the permission we need, and it ends when you delete the photo or your account.

What we ask of you

• Only add photos you are allowed to share.
• If other people are in the photo, make sure they are fine with it.
• No photos that are unlawful, hateful, sexual or that show someone in distress.

What we do

• Any player can report a photo. One report hides it for everyone straight away.
• We then look at it. If it is fine we show it again. If it is not, we remove it.
• We tell the person who added the photo what we decided and why, on their Notices page in the app. If they disagree they can tell us, and a person looks again.
• If someone keeps adding photos that get removed, we can limit or close their account.

Each uploaded image must not exceed 10 MB.

5. Plans and limits

What you can do depends on your plan. We may change the limits, and we will tell you in good time.

To keep the service safe there is a daily limit on deleting photos (Free with a confirmed identity and Trial: 2 a day, Pro: 25, Pro Plus: 100). It resets at midnight.

6. Trial, payments and when a plan ends

The trial is 30 days and free. You enter a card to start it. When the trial ends the card is charged and you move to Pro (€2.99 / month), unless you cancel before the trial ends. You can cancel at any time. The price, the date and the cancel button are on the billing page.

Pro and Pro Plus are billed monthly through Stripe. If you cancel, you keep the plan until the end of the period you paid for. We do not refund partial periods. If a payment fails we show you a notice in the app and try again for a few days.

When a trial or paid plan ends, you have a grace period of 30 days in which your photos and boards are kept. After that we delete all your photos and boards except your first photo and your first board, and you stay on the free plan with those. If a payment is still waiting for your bank to confirm it when the grace period ends, we wait up to 7 more days before deleting anything. You can come back to a paid plan at any time and add photos again. A trial can only be used once per person.

7. Prohibited Conduct

• Uploading content you do not have the right to share.
• Uploading or sharing any illegal content, including but not limited to content that is harmful, threatening, or violates applicable law.
• Attempting to reverse-engineer, scrape, or disrupt the Service.
• Using automated tools to create accounts or play games.
• Sharing your account credentials with others.
• Harassing, abusing, or sending offensive messages to other users. Abuse via in-game chat or any other communication channel will result in a permanent ban without appeal.

8. Intellectual Property

All software, design, and branding of the Service is owned by IsItBob and protected by applicable intellectual property law. You may not copy, modify, or distribute any part of the Service without our prior written consent.

9. Disclaimers & Limitation of Liability

The Service is provided "as is" without warranties of any kind. We do not guarantee uptime, data retention beyond our stated grace periods, or fitness for any particular purpose.

To the maximum extent permitted by law, IsItBob shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will make reasonable efforts to notify registered users of material changes.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which IsItBob operates, without regard to conflict-of-law provisions.
